Planning Together: Prenuptial & Postnuptial Agreements

Prenuptial and postnuptial agreements give couples the opportunity to define their financial expectations with clarity and intention- either before or after marriage. These agreements can address property, debt, and future planning, helping ensure decisions reflect each couple’s unique goals. When approached thoughtfully, they foster open communication and create a strong, transparent foundation for the future.

Clarity, Confidence, and Protection Before and After “I Do”

Premarital agreements, often called prenups, have become much more common in Texas and aren’t just for the wealthy. More couples are using them as a practical way to plan ahead and start their marriage with clarity.

At their core, prenups allow couples to set their own expectations instead of relying entirely on the default rules in the Texas Family Code. They can address things like property division, debt, and financial responsibilities, helping ensure the agreement reflects each couple’s unique goals and circumstances.

For example, some couples use prenups to keep student loan debt separate, while others- especially those with children from prior relationships- use them to protect assets and plan for their children’s future.

Postnuptial agreements offer similar benefits, but are created after a couple is already married. They can be especially helpful when circumstances change- such as starting a business, receiving an inheritance, or simply wanting clearer financial boundaries. Like prenups, they allow spouses to define how assets and debts are handled moving forward.

There are limits. These agreements can’t determine child support or include anything illegal, but within those boundaries, they offer meaningful flexibility.

Just as important as the agreement itself is the conversation. Approaching the topic with openness and shared goals can make the process a positive, team-focused experience. When done thoughtfully, these agreements aren’t about expecting the worst- they’re about creating a strong, transparent foundation for the future.
